Complaint by Attorney Dmytro Yagunov against Attorney Dmytro Zlati Referred for Consideration by the Bar Council of Odesa Region
By letter of 8 June 2026, the Bar Council of Odesa Region announced that the disciplinary complaint of attorney Dmytro Yagunov against attorney Dmytro Zlati has been placed on the agenda of a meeting of the Council. The meeting will take place on 17 June 2026 at 3:00 p.m. and the complaint will be considered by the Council sitting in full composition.
NO CONCILIATION WAS REACHED
The Conciliation Commission of the Committee on Lawyers’ Ethics under the Bar Council of Odesa Region, composed of three members (Dzhaburiia O.O., Semenov V.I., Sokaliuk V.P.), following the conciliation procedure held on 29 May 2026, found that conciliation between attorneys Yagunov D.V. and Zlati D.S. could not be achieved.
Under the law, a complaint by one attorney against another that may result in disciplinary liability is, where conciliation is not reached, always referred for consideration by the Bar Council sitting in full composition. The Conciliation Commission takes no decisions on the merits of the complaint.
SUBSTANCE OF THE COMPLAINT
The complaint was filed on 19 May 2026 and concerns the conduct of attorney Zlati D.S. in court hearings during 2025–2026 in cases connected with the so-called «ferry «Kyslytskyy»» (VYL-0224-K).
In particular, on 28 April 2026, attorney Zlati D.S. publicly maintained before the Kyiv District Court of Odesa the authenticity of title documents whose forgery has been confirmed by nine court judgments that have entered into legal force.
Among the forged documents is a “Vessel Technical Inspection Act” of 15 November 2015, purportedly signed by engineer-inspector Farvarshchuk V.D., who died on 10 July 2007 — eight years before the date on which the document was drawn up.
OPENNESS OF THE MEETING
In accordance with the settled case-law of the European Court of Human Rights, a qualification and disciplinary commission of the bar constitutes a “tribunal” within the meaning of Article 6 of the Convention for the Protection of Human Rights, since it determines disputes over the civil rights and obligations of persons engaged in a regulated professional activity (Le Compte, Van Leuven and De Meyere v. Belgium, 1981; Albert and Le Compte v. Belgium, 1983). Article 6 § 1 of the Convention guarantees that such disputes be heard publicly.
DATE AND FORMAT OF THE MEETING
The meeting of the Bar Council of Odesa Region will take place on 17 June 2026 at 3:00 p.m. The meeting of the Council is open to the public.
